Terms of Service

These terms of service govern access to and use of the Oolel Maps services, including the websites, mobile application, developer area, APIs, mapping content, and any related features. By accessing or using these services, you agree to be bound by these terms.

If you do not accept these terms, you must stop using the Oolel Maps services.

1. Definitions

In these terms, the following words have the meanings set out below:

  • Oolel, we, our: the entity operating Oolel Maps.
  • Services: the websites, mobile application, APIs, developer tools, mapping content, navigation features, and any related service.
  • User: any person who accesses or uses the Services.
  • Account: a personal or professional space created to access certain features.
  • Content: any data, information, text, image, report, route, comment, file, or other item transmitted or displayed within the Services.

2. Acceptance of the terms

Use of the Services implies full and unreserved acceptance of these terms. Oolel may refuse access to all or part of the Services to anyone who does not comply with these terms or who poses a risk to the security, integrity, or proper functioning of the Services.

The user declares that they have the legal capacity required to accept these terms. If the user is acting on behalf of a company or organization, they declare that they are authorized to bind that entity.

3. Description of the Services

Oolel Maps offers, among other things, mapping, place search, navigation, geolocation, route calculation, and map personalization services, as well as tools for developers through an interface or APIs.

The Services also allow users to contribute map content (addresses, places, businesses, points of interest), claim and manage business listings, and share routes or locations through public links.

The Services may change, be modified, suspended, or removed at any time, in whole or in part, without specific notice when required for technical, security, compliance, or product improvement reasons.

4. Account creation and management

Certain features require creating an account. The user agrees to provide accurate, complete, and up-to-date information during registration and to keep it up to date.

The user is responsible for the confidentiality of their credentials and for all activity carried out through their account. Any unauthorized or suspected use of the account must be reported to Oolel immediately.

Oolel reserves the right to suspend, restrict, or delete an account in the event of a breach of these terms, fraud, abuse, unlawful use, or security risk.

5. Permitted use

The user agrees to use the Services lawfully, fairly, and in accordance with these terms and applicable laws.

In particular, the user must not:

  • divert the Services from their intended purpose;
  • compromise the security, integrity, or availability of the Services;
  • attempt to gain unauthorized access to an account, API, server, or data;
  • automate access to the Services without express authorization;
  • extract, copy, index, or reuse mapping data or content of the Services on a large scale without authorization;
  • circumvent technical restrictions, quotas, usage limits, or security mechanisms;
  • distribute unlawful, misleading, defamatory, hateful, violent, or fraudulent content;
  • use the Services to harass, surveil, profile, or harm a person;
  • introduce viruses, malicious scripts, or any harmful payload.

6. Geolocation and navigation

Some features rely on geolocation. The user may be asked to authorize access to their device's location in order to use these features.

The user acknowledges that location data, routes, and place searches may vary depending on signal accuracy, network coverage, device settings, and available data.

Oolel does not guarantee that navigation, route, traffic, or location information is free of errors, complete, or always up to date. The user remains responsible for their own vigilance, judgment, and compliance with local traffic laws and rules.

7. Developer area and APIs

Access to the developer area and APIs may require creating a dedicated account, obtaining API keys, and accepting supplementary terms.

The developer user agrees to:

  • protect their API keys and not disclose them;
  • respect quotas, technical limits, and usage rules;
  • not use the APIs for illegal, abusive, or unauthorized purposes;
  • not resell, sublicense, or repurpose the Services except with express authorization;
  • not alter, disassemble, or seek to circumvent security or access-control mechanisms.

Oolel may suspend, restrict, or revoke API access in the event of abuse, overload, violation of these terms, or risk to the platform.

8. User-provided content

The user remains responsible for the content they submit, publish, transmit, or store through the Services.

By submitting content, the user represents that they hold all rights necessary for its use and authorizes Oolel to host, process, reproduce, display, and transmit it to the extent necessary for providing the Services.

By submitting map content (addresses, places, business information, edits, photos, or comments), the user grants Oolel a worldwide, royalty-free, sublicensable license to reproduce, adapt, publish, translate, and distribute that content as part of the Oolel Maps services, including within publicly accessible map data. The user retains ownership of their content.

Oolel may review, moderate, edit, reject, or remove user-submitted content that breaches these terms, applicable law, or the quality rules of the map.

The user warrants that their content does not violate any third-party rights, applicable law, or these terms.

9. Business listings

The Services allow businesses to be listed on the map. Business listings, once validated, are publicly visible.

A business owner or authorized representative may claim a listing, subject to the verification checks required by Oolel. Once a listing is claimed, the owner is responsible for the accuracy, lawfulness, and appropriateness of the information they publish about their business.

Oolel may, at its discretion, merge duplicate listings, correct manifestly incorrect information, remove fraudulent or abusive listings, and revoke a claim in the event of abuse, impersonation, or breach of these terms.

10. Intellectual property

The Services, their architecture, design, software, trademarks, logos, texts, interfaces, databases, maps, data compilations, graphic elements, and protected content are the property of Oolel or its partners/licensors, unless stated otherwise.

No ownership right is transferred to the user merely by accessing the Services.

Unless prior written authorization is obtained, it is prohibited to:

  • copy or reproduce protected elements of the Services;
  • modify, translate, or create derivative works;
  • decompile or attempt to reconstruct the source code;
  • use the trademarks, logos, or distinctive signs of Oolel;
  • commercially exploit the content or data of the Services without authorization.

11. License to use

Oolel grants the user a personal, non-exclusive, non-transferable, revocable, and limited license to access and use the Services in accordance with these terms.

This license does not allow reselling, sublicensing, bulk copying, distributing, or exploiting the Services outside the authorized use.

12. Availability and maintenance

Oolel strives to provide continuous access to the Services but does not guarantee that they will be available without interruption, error, or maintenance.

Interruptions may occur due to maintenance, updates, outages, security incidents, technical causes, third-party dependencies, or force majeure.

13. Personal data and privacy

Use of the Services involves the collection and processing of certain personal data in accordance with the applicable privacy policy.

Users are invited to review that policy to understand what data is collected, for what purposes, how long it is retained, and what rights they can exercise.

14. Third-party services

The Services may contain links, components, or integrations provided by third parties. Oolel is not responsible for the availability, content, security, or practices of such third parties.

Use of these third-party services may be subject to their own terms and policies.

15. Notifications and communications

Oolel may send the user communications related to the account, the service, security, maintenance, or material changes to the terms.

The user may also receive, where they have consented, marketing or informational communications. Consent can be withdrawn through the mechanisms provided.

16. Suspension and termination

Oolel may, at its sole discretion, suspend, restrict, or terminate the user's access to all or part of the Services in the event of:

  • breach of these terms;
  • fraudulent or abusive use;
  • threat to the security or integrity of the Services;
  • legal obligation or request from a competent authority;
  • prolonged inactivity, in accordance with applicable rules;
  • conduct likely to harm Oolel, its users, or third parties.

The user may stop using the Services at any time and, subject to applicable conditions, request the deletion of their account.

17. Limitation of liability

To the extent permitted by law, Oolel shall not be liable for indirect damages, loss of profits, loss of data, business interruption, commercial harm, or damages resulting from the use of or inability to use the Services.

Oolel does not warrant:

  • the absolute accuracy of maps, routes, places, or navigation information;
  • the absence of errors or omissions in the Services;
  • permanent compatibility with all devices, systems, or networks;
  • the absence of harmful elements originating from third parties.

Nothing in these terms has the effect of excluding any liability that cannot be legally excluded.

18. Indemnification

The user agrees to defend, indemnify, and hold Oolel, its officers, employees, partners, and providers harmless from any claim, damage, loss, liability, cost, or expense arising from:

  • their use of the Services;
  • breach of these terms;
  • violation of a third party's rights;
  • the content they submit or distribute;
  • use of their credentials or API keys by themselves or by a third party they authorized.

19. Changes to the terms

Oolel may amend these terms at any time to reflect changes in the Services, legal obligations, or its practices.

In the event of a material change, Oolel may inform users by any appropriate means. Continued use of the Services after the new terms come into effect constitutes acceptance of them.

20. Governing law and jurisdiction

These terms are governed by the laws of the Islamic Republic of Mauritania, subject to mandatory consumer-protection or data-protection rules that may apply in your country of residence.

In the event of a dispute, and unless otherwise provided by law, the competent courts shall be those of Nouakchott, Mauritania.
